NYSDEC Denies Air Permit Renewal for CPV Valley Power Plant:
Project at Center of Percoco Conviction 


Slate Hill NY: One day after the air permit expired for the Competitive Power Ventures fracked gas power plant in Wawayanda New York, the State Department of Environmental Conservation denied the company’s Air Facility Permit renewal application, citing failure to submit a federal Title V air permit application, usually required for plants of this size.

Protect Orange County submitted a letter to DEC on Tuesday, July 31 requesting denial of the permit based on several facts including the lack of an accurate greenhouse gas emissions analysis, documented health impacts, and invalid emissions reduction credits. However, central to all those issues was the corruption involved. Evidence presented during the trial of former Cuomo aide Joseph Percoco, along with CPV executive Peter Braith Kelly revealed a lengthy quid-pro-quo bribery scheme to facilitate the project’s approvals along with other benefits.

“While this is a step in the right direction and we are deeply grateful for DEC’s denial we cannot declare victory until all operations cease, deconstruction commences, and the Millennium expansion comes to a grinding halt.” Said Pramilla Malick, the Chair of Protect Orange County.

The Eastern System Upgrade expansion is underway in both Orange and Sullivan Counties which is designed to help gas flow to the CPV Power Plant. Sullivan County Residents Against Millennium have been leading the opposition to that project which is currently threatening water resources, as well as tearing up critical forests and farmland.

“Although we applaud Governor Cuomo and NYS DEC for their decision to deny the air permit renewal for CPV, it is, however, premature to celebrate. If NY is serious about its energy policy, it is essential that CPV is decommissioned and Millennium Pipeline ESU construction is halted and rolled back.

There are still many unanswered questions about how these projects received their permits and we encourage AG Barbara Underwood to conduct a vigorous investigation. Until that time, we will continue to raise awareness around these unwanted and unlawful projects, as well as shine a spotlight on the politicians and lobbyists who, despite widespread community opposition, facilitated their building in the first place.”, said George Billard, Co-Founder – SCRAM

Call Governor Cuomo at 877-235-6537 to say we need a complete shutdown of CPV and all fracked gas power plants in New York.  It’s great that Governor Cuomo took action to delay the poisonous CPV power plant, but now we need him to make sure this plant and all other fracked gas power plants across New York shut down permanently to address the climate crisis and to protect the health and safety of all New Yorkers.

We will continue to hold Governor Cuomo accountable to the verbal commitment he made to not approve any fracked gas power plants.

We stopped fracking in New York and together we can stop all fracked gas infrastructure.

Grandmother, Retired Teacher Jailed Up to Six Months
for Protecting Her Land

Ellen Sue Gerhart, 63, has been a key leader in the multi-year campaign against Energy Transfer Partners’ Mariner East 2 natural gas liquids pipeline, which is being built through her property.

[Huntingdon, PA] On Friday, August 3, Huntingdon County Judge George Zanic sentenced 63-year-old grandmother, retired teacher, and landowner Ellen Sue Gerhart to two to six months in jail and a $2,000 fine for indirect criminal contempt of court.

Judge Zanic’s decision was based on accusations from lawyers for Texas-based oil and gas giant Energy Transfer Partners (ETP), the developer of the pipeline project through Gerhart’s land. The company alleged that Gerhart had baited a bear onto the pipeline easement on her wooded 27-acre property.

Elise Gerhart, daughter of Ellen, said, “If you build a pipeline through the woods, you should expect to see bears and other wildlife. Judge Zanic gave this $50 billion company the power of eminent domain over my family’s property and our governor gave them the permits. My mom’s protest on her own property is not the injustice here.”

In an interview prior to her arrest, Ellen Gerhart said, “We’ve had no choice but to take a stand and defend what our government officials are unwilling to protect. Our right to peacefully object to an unjust and dangerous pipeline should be protected over the profit margin of these foreign corporations.”

Rich Raiders, attorney for the Gerhart family, said “The eminent domain condemnation case filed by Sunoco against the Gerharts remains ongoing. The Gerharts have also appealed Sunoco’s environmental permits granted by the Department of Environmental Protection concerning the wetlands permits issued to Sunoco on this project. The trial before the Environmental Hearing Board is scheduled for August 29th.

Raiders continued, “Their are still charges of harassment and unlawful taking alleged against Mrs. Gerhart pending. Mrs. Gerhart believes that these charges are a distraction from Sunoco’s ongoing litany of permit suspensions, failed horizontal directional drilling, and various project delays. We believe that the company did not present evidence to prove beyond reasonable doubt that Mrs. Gerhart’s protests were criminal. Mrs. Gerhart disagrees with Judge Zanic’s decision today and is reviewing her options and will pursue her rights to the fullest extent.”
